An Introduction to the Human Rights Movement

Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people,
Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law...

These are the second and third paragraphs of the preamble to the Universal Declaration of Human Rights (UDHR), adopted by the United Nations General Assembly on December 10, 1948 without a dissenting vote. It is the first multinational declaration mentioning human rights by name, and the human rights movement has largely adopted it as a charter. I'm quoting them here because it states as well or better than anything I've read what human rights are and why they are important.

The United Nations Charter, Universal Declaration of Human Rights, and UN Human Rights convenants were written and implemented in the aftermath of the Holocaust, revelations coming from the Nuremberg war crimes trials, the Bataan Death March, the atomic bomb, and other horrors smaller in magnitude but not in impact on the individuals they affected. A whole lot of people in a number of countries had a crisis of conscience and found they could no longer look the other way while tyrants jailed, tortured, and killed their neighbors.

Many also realized that advances in technology and changes in social structures had rendered war a threat to the continued existence of the human race. Large numbers of people in many countries lived under the control of tyrants, having no recourse but war to relieve often intolerable living conditions. Unless some way was found to relieve the lot of these people, they could revolt and become the catalyst for another wide-scale and possibly nuclear war. For perhaps the first time, representatives from the majority of governments in the world came to the conclusion that basic human rights must be protected, not only for the sake of the individuals and countries involved, but to preserve the human race.

My Reasons for Working for Human Rights
My reasons for believing in and supporting human rights stem from what I saw growing up in El Paso, Texas, less than two miles from the border with Mexico and Mexico's second largest city, Cuidad Juarez. Like most border cities, Juarez was filled with very poor people who had left the countryside looking for a better life. They were prey to every kind of abuse, from harrassment to false imprisonment to beatings to rape to politically-motivated murder by authorities and others on both sides of the border with more power and influence than they had.


I doubt I would have known such things existed from my own experience. It became part of my experience, though, and I've never since been able to take my freedom and lack of fear for granted.

House Medical Clinic, an 11-physician multi-specialty medical clinic.

He served two years as Captain Medical Officer in the US Army and 30 years as the Federal Aviation Administration Medical Examiner. He has been past President and is current Chairman of the Board of Lifestyle Center of America.

Abroad he was a founding member of Canvasback Missions, Inc., a medical, dental, and nursing mission serving the islands of the North Pacific (Marshall Islands and Federated States of Micronesia). He served as a short-term doctor for 15 stints over 13 years in the Pacific Islands. He also served 5 episodes of short-term service in Transylvania, Romania, at the Herghelia Lifestyle Medical Center.

The Bible says about the Gay and Lesbians: Romans 1:18-32
1:18 For the wrath of God is revealed from heaven against all ungodliness and unrighteousness of people who suppress the truth by their unrighteousness, 1:19 because what can be known about God is plain to them; because God has made it plain to them. 1:20 For since the creation of the world his invisible attributes—his eternal power and divine nature—have been clearly seen, because they are understood through what has been made. So people are without excuse. 1:21 For although they knew God, they did not glorify him as God or give him thanks, but they became futile in their thoughts and their senseless hearts were darkened. 1:22 Although they claimed to be wise, they became fools 1:23 and exchanged the glory of the immortal God for an image resembling a mortal human being and birds and four-footed animals and reptiles.1:24 Therefore God gave them over in the desires of their hearts to impurity, to dishonor their bodies among themselves. 1:25. They exchanged the truth of God for a lie and worshiped and served the creation rather than the Creator, who is blessed forever! Amen.1:26 For this reason God gave them over to dishonorable passions. For their women exchanged the natural sexual relations for unnatural ones, 1:27 and likewise the men also abandoned natural relations with women and were inflamed in their passions for one another. Men committed shameless acts with men and received in themselves the due penalty for their error. 1:28 And just as they did not see fit to acknowledge God, God gave them over to a depraved mind, to do what should not be done. 1:29 They are filled with every kind of unrighteousness, wickedness, covetousness, malice. They are rife with envy, murder, strife, deceit, hostility. They are gossips, 1:30 slanderers, haters of God, insolent, arrogant, boastful, contrivers of all sorts of evil, disobedient to parents, 1:31 senseless, covenant-breakers, heartless, ruthless. 1:32. Although they fully know God’s righteous decree that those who practice such things deserve to die, they not only do them but also approve of those who practice them.

Late Antique and Byzantine Studies

MA in Late Antique and Byzantine Studies
Normally a first or upper second class degree in an arts subject, including some element relating to classical antiquity or the Middle Ages.

There are comparable requirements for non-UK students. For example, the normal requirement for applicants from American universities using the 4-point system is a GPA of at least 3.4, or for Greek applicants an average of 7.5 in their university courses. Non-native English speakers must have an appropriate qualification in the English language, details of which can be found on the general pages of the website.

JSIJ is a peer-reviewed, electronic journal dealing with all fields of Jewish studies, which is distributed free of charge via the Internet.
By publishing articles electronically via the Internet, JSIJ seeks to disseminate articles much faster than is possible with paper publication, and to make these articles readily and conveniently accessible to a wide variety of readers at all times.

Indeed, we hope that the use of this new technology will eventually allow JSIJ to develop in ways not available with conventional, printed journals, including the possibility of computerized full-text searching and the use of hyperlinks to other texts.

JSIJ will include articles in both Hebrew and English. To render these articles accessible to as wide a variety of users as possible, regardless of computer program or platform, we offer two modes of "publication": via PDF files (universally accessible) and Word 97 files.

מלשכת הגזית לחנות, ומחנות לירושלים, ומירושלים ליבנה,
ומיבנה לאושא, ומאושא ליבנה, ומיבנה לאושא,
ומאושא לשפרעם, ומשפרעם לבית שערים,
ומבית שערים לצפורי, ומצפורי לטבריא.

חזרתה של סנהדרין ליבנה, לאחר שכבר עברה משם לאושה שבגליל, לא נתקבלה על דעתם של חוקרים אחרונים, לפי שמבחינה ריאלית-היסטורית קשה לכלכלה. דומה אפוא שיפה עניין זה לדון הימנו ביחס שבין חקר ההיסטוריה לחקר מסורת הנוסח. ונפתח בדבריו של ראש המדברים בכל מקום, הלא הוא י"נ אפשטיין. בחיבורו מבוא לנוסח המשנה (עמ' 1198) מכריע אפשטיין דרך ודאי, כי רק גלות אחת הייתה מיבנה לאושא; וגרסת התלמוד שלפנינו אינה אלא פרי הגהתו של רש"י, מדעתו בלבד. מסקנה זו מבסס אפשטיין על עדי נוסח המשמיטים את התיבות המודגשות דלעיל. בלא זיקה לדברי אפשטיין קבע אף גדליה אלון, כי "נוסחאות עיקריות שבתלמוד אינן גורסות 'ומיבנה לאושא ומאושא ליבנה', הרי שאסמכתא זו בטילה". מוסיף עליו תלמידו ש' ספראי, כי הואיל ושני החכמים העמידונו שתיבות אלה "אינן מצויות לא בכתבי יד, לא אצל הראשונים ולא בדפוסים הקודמים", הרי "יש לראות עניין זה כמבורר וגמור". ח"ד מנטל הצטרף אף הוא לקביעה זו, אך משתדל לדייק בה: "עובדה היא שאין הן [התיבות דלעיל] מופיעות בששת כתבי היד של הבבלי שבידינו". ובעקבי חכמים אלה מהלכים גם חוקרים נוספים.
קודם שנשאל כיצד יושלם מניין עשר המסעות אם אכן תושמטנה התיבות דלעיל, יש לנו להעמיד על העובדות הטקסטואליות, כמות שהן בידינו כיום. בעל דקדוקי סופרים על אתר כבר ציין לכ"י מינכן ולדפוסים הישנים, וכן לילקוט שמעוני, אוצר הכבוד לר' טודרוס אבולעפיה, הגדות התלמוד (קושטנטינא רע"א) וכתב יד של ילקוט מדרשים על התנ"ך: הללו אינם גורסים את התיבות האמורות. אך לאלה יש להוסיף ששה כתבי יד של בבלי ראש השנה, ובכללם שני קטעי גניזה, וכן גם ילקוט המכירי (ישעיה נב, ב, עמ' 193). ברם, צדו השני שלמטבע מאושש היטב אף הוא: שיבתה של סנהדרין ליבנה, לאחר שכבר נסעה הימנה לאושה, מקוימת בארבעה כתבי יד שלבבלי, לרבות קטע גניזה מזרחי ממפנה המאות הי'-י"א, וכן ברש"י, בכפתור ופרח לר' אשתורי הפרחי ובעין יעקב (שאלוניקי רע"ו). הצגת הדברים בידי החוקרים דלעיל לקתה אפוא בחד צדדיות מובהקת, וכבר אין טעם לדון את גרסתנו כ"אסמכתא בטילה". מעתה יש לעיין בשאלת מקור היווצרותם של חילופי הנוסח.
השמטת המסעות "מאושא ליבנה ומיבנה לאושא" בעדים דלעיל מעוררת קושי מיידי: כיצד נגיע למניין עשרה האמור בדברי ר' יוחנן? שתי גישות נקטו החוקרים בעניין זה: אפשטיין מצביע על מניין חלופי: מלשכת הגזית <לחמת ומחמת> לחנות ומחנות <לחיל ומחיל> לירושלים ומירושלים ליבנה ומיבנה לאושא ומאושא לשפרעם וכו'. מניין זה אינו מצוי אלא בהגדות התלמוד, וכן בכתב יד של ילקוט מדרשים המובא בידי בעל דק"ס; ודווקא על גרסה זו סמך אפשטיין את ידיו כנוסח המקורי. אישוש למסורת זו באשר ל'חמת' מצא אפשטיין בדברי יוסף בן מתתיהו, המזכיר את 'חמת' או 'חמתא' כאחד מחמשה מקומות שקבע בהן גביניוס, הפרו-קונסול הרומאי בסוריה (57-55 לפני הספירה), סנהדריות. ואשר ל'חיל', הרי מצינו מקורות המזכירים את ה'חיל' כמקום ישיבת בית הדין.
על הצעת 'חמת' השיג מנטל בטיעון היסטורי: לדעתו, צדקו האומרים כי סנהדריות מחוזיות שנזכרו אצל יוספוס אינן כלל עניין לסנהדרין הדתית שבלשכת הגזית. אך יותר יש לתמוה מה עניין חמת, שמחוץ לירושלים, לשלב זה במסעותיה של הסנהדרין, כאשר עדיין לא עזבה את העיר? ולפי דרכנו יש תחילה לשאול: כיצד נעלמה מסורת זו משאר כל העדים כולם - אם אמנם היא המקורית? נראים הדברים, ש'חמת' אינה ידועה לבעלי גרסה זו ממסורת היסטורית מקורית המשתלשלת עד יוספוס, אלא לפנינו חילוף גראפי רגיל בין 'חנות' ל'חמת' (צירוף נו"ן ווי"ו נראה כמ"ם): הואיל והשמטת שיבתה של סנהדרין ליבנה החסירה את המניין הדרוש, ביקש הסופר להשלימו; ואת חפצו הוא מצא בנוסח 'חמת', שוודאי עמד לפניו כחילוף שבגליון לנוסח 'חנות'. ואמנם, כבר צוין חילוף 'חנות' שבענייננו ב'חרות'. מעתה אין תימה בעמידתה של 'חמת' שלא במקומה הגיאוגרפי, אלא דווקא בסמוך ל'חנות': הרי אין הולדתה אלא בחילוף נוסח מזו האחרונה.
ברם, טיעון זה אינו עניין לגרסת 'חיל': זו אכן מופיעה במקורותינו כאחד ממקומות בית הדין שבהר הבית, ותואמת היא אפוא את השלב הנידון שבמסעות הסנהדרין. ואמנם, באוצר הכבוד מצוי המסע 'מחנות לחיל' - אף שאינו גורס את המסע לחמת. ברם, אף גרסה זו מוקשה ביותר, שהרי היא מקיימת תשעה מסעות, תחת עשרה. והוא הדין בשאר כל העדים שאינם גורסים חזרה ליבנה, שאין להם אלא שמונה מסעות בלבד. הא כיצד? מנטל סבור אפוא, שבסוגיא שלפנינו מצוי זכרו של המסע העשירי. כי לאחר שהובאה דעתו החולקת של ר' אלעזר שרק ששה מסעות הם, הובאו שוב דברי ר' יוחנן: "ומשם [=מטבריה, מקום החניה האחרון שלסנהדרין] עתידין ליגאל, שנאמר 'התנערי מעפר קומי שבי'". הרי לנו אפוא המסע העשירי, מטבריה חזרה למקומה המקורי של סנהדרין בלשכת הגזית. ומכאן, טוען מנטל, כבר קל לשער מהו המסע הנוסף, שחסר לגרסה דלעיל, ומשלים מניין עשרה: מאוהל מועד ללשכת הגזית. במימרת ר' יוחנן שלפנינו תוארו אפוא שמונה מסעות, אך זאת משום שרב יהודה בר אידי המוסרה השמיט את הראשון והאחרון; אלא שהשני מהם הובא לבסוף בסיום הסוגיא.
ברם, דומה שאין עמידה לקונסטרוקציה זו. כי נוסף לכך שלא הוסבר מדוע השמיט המוסר את המסע הראשון, הרי המסעות בלשונו של ר' יוחנן אמורים בלשון עבר ("גלתה"), והמסע העתידי חזרה אינו אפוא בכלל. יתרה מזו: עשרת מסעותיה של סנהדרין לא הובאו בידי ר' יוחנן אלא כהקבלה ("כנגדן") למסעותיה של השכינה, שעולים לאותו מניין, והובאו בה במימרה. מסעות אלה שלשכינה מתארים, בעקבות כתובי יחזקאל שהובאו שם, את גלותה שלשכינה, עקב אירועי החורבן. אין תימה מעתה שמסעותיה של סנהדרין אכן מתוארים בדברי ר' יוחנן כגליות: מדובר בעזיבה מכורח, שהוצרכה סנהדרין לעזוב את מקומה הראוי לה בלשכת הגזית. אבל המסעות מאוהל מועד לירושלים, ומטבריה חזרה ללשכת הגזית, שכך יאה להם וכך ראוי להם לכתחילה, אינם עניין למסגרת זו מעיקרה.
מעתה נמצינו למדים: מחד גיסא, קשה לראות את הנוסח המשמיט את שיבתה של סנהדרין ליבנה כנוסח מקורי, לפי שאין בידינו להשלים לפיו מניין עשרה. מאידך גיסא, אם נראה בגרסה הרווחת את הנוסח המקורי ("מאושה ליבנה ומיבנה לאושה"), לא יהא קושי של ממש לבאר את היווצרותה של הגרסה החלופית: הרי זו באה בנקל מדילוג הדומות ("ומיבנה לאושא ומאושא ליבנה ומיבנה לאושא"); וכל העוסק בכתבי יד יודע כי דילוג הדומות הוא עניין שכיח מאין כמותו, ואין הדבר מן הנמנע שיימצא בכתבי יד שונים ובלתי תלויים זה בזה. אף על פי כן, תיעודה הנרחב של הגרסה הקצרה בענייננו מקשה קמעא על אימוצו של פתרון זה כמניע בלעדי להיווצרות חילופי הנוסח בסוגיא. אכן, נתון נוסף מצוי כיום בידינו, ונראה שיש בו לקדם את הדיון, כדלהלן.

ב. פיוט ומשמעו

בשנת תש"ל פרסם עזרא פליישר קינה עתיקה, כנראה קלירית, המתארת את עשרת מסעותיה של הסנהדרין. המסורת שביסוד הפיוט אינה זהה לזו שהבבלי מוסר בעניין זה בשם ר' יוחנן, והמהדיר רואה בה מקור ארץ ישראלי מקורי על תולדות הסנהדרין. נביא כאן את לשון הפיוט בתיאור המסעות, מן הרביעי עד השביעי:

... כנסעה סנהדרין מירושלים ליבנה.
...כנסעה סנהדרין מיבנה לאושה.
...כנסעה סנהדרין מאושה ליבנה שבה.
...כנסעה סנהדרין מיבנה שבה לבית שעריים.

הקושי גלוי לעין: מה הלשון אומר "מיבנה שבה לבית שעריים", שעה שכלל לא הייתה שם קודם לכן? פליישר הציע משום כך שתיבת "שבה" אינה פועל המתאר את נסיעת הסנהדרין, אלא כינוי לוואי יש כאן לשם יבנה: מאושה לא נסעה סנהדרין ליבנה הידועה, שהרי את זו כבר עזבה בהגיעה לאושה; ופליישר הולך בעקבי הסבורים שאין יסוד ממשי לגרסת הבבלי שלפנינו. אלא מדובר בפיוט ביבנה אחרת, השוכנת בגליל, והיא "יבנה שבה". מעתה ברור שלא שבה סנהדרין לבית שעריים, שם לא הייתה תחילה; אלא שמ"יבנה שבה" נסעה לבית שעריים. ברם, לא מעט מן הדוחק יש בהצעה זו. כי מלבד עמימות הכינוי "שבה", שאין לו זיקה לשם היישוב הגלילי, אף עצם הזיהוי עומד בספק גדול, כפי שהראה רוזנסון. סברתו של רוזנסון היא אפוא ש"שבה" אכן מתאר את פעולת המעבר של הסנהדרין, אלא שאין לפרשה כשיבה (שהרי מעולם לא הייתה קודם לכן בבית שעריים), כי אם במובן היעשות והקרוב לו: כנסעה סנהדרין מיבנה והפכה ונעשתה בת בית שעריים. אך באשר לתיאור המסע מאושה, הדברים כמשמעם: "כנסעה סנהדרין מאושה ליבנה שבה" - שהרי לפי מסורתו של הפיוט כבר הייתה סנהדרין ביבנה תחילה, ועתה שבה אליה מאושה. ברם, גם הצעה זו נאחזת בסבך. כי נוסף לדוחק שבפירוש תיבת "שבה" בשתי היקרויות סמוכות לפי משמעים שונים לגמרי, הרי אם שינוי ההוויה הוא מבחינת המגורים במקום חדש אין הוא עניין למסע זה דווקא, ואפשר היה לו להיאמר בכל מסע אחר; ואם הכוונה לרמוז ש"שעריים" עניינו בית דין היושב בשער, הרי שינוי ההוויה אינו עניין לכך: באופיה של סנהדרין לא נתחדש דבר.
נראה אפוא שצדק פליישר כי "שבה" מתפרש באותו אופן בשני הבתים; ומאידך גיסא, צדק רוזנסון שאין "שבה" כינוי לוואי ליבנה, אלא פשוטו כמשמעו. כי נסיעת סנהדרין מיבנה לבית שעריים משמעה הגיאוגרפי הוא מעבר מן הדרום אל הגליל. אך הואיל וסיפר הפייט שכבר שכנה הסנהדרין קודם לכן באושה שבגליל, לשם עברה מיבנה, נמצא שבנסיעתה כעת מיבנה לבית שעריים שבה הסנהדרין מן הדרום לגליל כבתחילה! עתה עולים כל הדברים כפשוטם: "כנסעה סנהדרין מאושה ליבנה שבה" - שהרי בדרום הייתה תחילה, קודם שעברה משם לאושה שבגליל; "כנסעה סנהדרין מיבנה שבה לבית שעריים" - שהרי בגליל הייתה תחילה, באושה, קודם שחזרה משם ליבנה שבדרום.
ואמנם, לשונות התיאור של המסעות בפיוט מושפעים מן התוואי של הדרך. שהרי כך מצינו בשורת הסיום: "...כנסעה סנהדרין מציפורין וירדה לטיבריה". לא סגי אפוא בעצם הנסיעה, אלא הפייט מעלה אף את התוואי הטופוגרפי: מעבר מציפורי שבהרים לטבריה שבבקעה הרי הוא ירידה טופוגרפית. וכך הלא גם בדברי ר' יוחנן שבבבלי: "וטבריא עמוקה מכולן, שנאמר 'ושפלת מארץ תדברי'". הוא הדין אפוא במעבר מיבנה שבדרום לבית שעריים שבצפון: אף שלבית שערים עצמה לא הגיעה סנהדרין קודם לכן, מכל מקום הרי כאן שיבה לגליל, שבו כבר שכנה תחילה, באושה. הפייט הארץ ישראלי מבטא אפוא לפי תומו את היכרותו עם מפת הארץ.
לפי דרכנו למדנו, ששיבת הסנהדרין בפיוט זה אמורה לעולם כמשמעה הריאלי; ומכאן יש אפוא ללמוד על מסורת ארץ ישראלית אותנטית, שהייתה אמנם שיבה של הסנהדרין ליבנה - לאחר שכבר נסעה ממנה לאושה. מסורת הבבלי לפי דפוסינו וסיעתם מתאששת אפוא באופן מובהק - מאותה מציאה ארץ ישראלית כשרה שעלתה מן הפיוט.

ג. להתהוות חילופי המסורות

אף-על-פי שהפיוט הארץ ישראלי משמש חיזוק גדול לשיבתה של סנהדרין מאושה ליבנה, יש לשים לב כי השיבה הנוספת המופיעה בדפוסינו - מיבנה לאושה בשנייה - אינה מקוימת בפיוט. מניין עשרה הושלם במסורת הפיוט באמצעות מסע, שאין לו ביטוי כלל בעיקר עדי הבבלי: מלשכת הגזית לא עברה סנהדרין במישרין לחנויות, אלא בין לבין חנתה בהר הבית. ונראים הדברים, שמכאן יש בידינו לשחזר דרך השערה סבירה את השתלשלות המסורות בפרשתנו. הרי לא מצינו מקור לעשר הגליות אלא במימרת ר' יוחנן, ופיוטנו מקבל מימרה זו הן באשר לחניה הכפולה ביבנה והן באשר להטעמת הירידה שבמעבר לטבריה. יש אפוא סבירות להנחה שפיוט זה לא נבנה אלא על מסורת זו שבדברי ר' יוחנן, כפי שנמסרו בארץ ישראל. ההבדלים בין המסורת השקועה בפיוטנו לבין המימרה שבבבלי אינם לפי זה פרי השוני שבין שתי מסורות בלתי תלויות ונבדלות זו מזו; אלא מסורת הפיוט מעידה על מימרת ר' יוחנן המקורית, כפי שנלמדה בארץ ישראל, ואילו צורת המימרה שבבבלי היא פרי עיבוד שעובדו הדברים בבבל. במקורה העידה אפוא המימרה על שיבה מאושה ליבנה, אך משם לא הייתה שיבה שנייה לאושה, אלא מעבר לשפרעם; ומניין עשרה נשלם באמצעות המסע מלשכת הגזית להר הבית.
מעתה יש לומר שמהלכו של העיבוד הבבלי נעשה בשני שלבים. כי בניגוד לעניין החזרות ליבנה ולאושה, שבהם החילופים מרובים, הרי מוסכם כמעט בכל עדי הבבלי שאין כל תחנה בין לשכת הגזית לבין החנויות. ואפשר שהשמטה זו מן המימרה המקורית באה בעקבות מסורת הרווחת בבבלי בשמו של ר' יוסי, שגלותה של סנהדרין ממקומה הראשון הייתה לחנות (או לחנויות): "ארבעים שנה עד שלא חרב הבית גלתה סנהדרין וישבה לה בחנויות". סנהדרין לא גלתה אפוא ממקומה הראשון אלא לחנויות, וסמי מכאן תחנת ביניים. בין שזו סיבת ההשמטה ובין אחרת, נמצא מכל מקום המניין המקורי - הכולל שיבה ליבנה, אך לא שיבה לאושה - חסר בבבלי חוליה אחת. ואכן, במתכונת זו ממש מצוי המניין בנוסח התלמוד שבכפתור ופרח: "מירושלם ליבנה, מיבנה לאושא, מאושא ליבנה, מיבנה לשפרעם".
מעתה שמניינו של הבבלי נחסר מסע אחד, הועלו שתי גישות אצל הלומדים. היו שראו צורך להשלים את המניין, ומכאן כפילות החניה באושה: הואיל ובסדר המסעות שבה סנהדרין מאושה ליבנה, הרי בסמוך לכך כפלו הלומדים אף את חנייתה של אושה, ובכך השלימו למניין עשרה. אך מאלף הדבר כי היו מן הלומדים שבלא דעת השיבו את המצב לקדמותו: הואיל והיה צורך במסע נוסף, נאחזו הללו במקורות המצביעים על מקומו של בית הדין בהר הבית, מעבר ללשכת הגזית; ומכאן עלה החיל. ודומה שכך ממש נוצרה המסורת המקורית המשתקפת בפיוט: כדי להשלים מניין עשרה, שיקביל למסעות השכינה, נאחז המדרש בידוע על מקומו של בית הדין בהר הבית. ה"חיל" בקצת גרסאות הבבלי ו"הר הבית" שבפיוט צומחים אפוא בתהליך מקביל.
שיקול אחרון זה, בדבר הרקע ליצירתה של המסורת המקורית מתוך הקבלה למסעות השכינה, דומה שיש בו לשוב ולאשש את השיבה מאושה ליבנה, מזווית נוספת; ומאידך גיסא, יש כאן אף כדי להאיר מחדש את גרסת העדים המשמיטים שיבה זו. שהרי במימרת הבבלי על מסעות השכינה לא בא לידי ביטוי מוטיב המוטעם במקבילות. וכך למדנו באיכה רבתי, פתיחתא כה:

עשר מסעות נסעה השכינה: מכרוב לכרוב, ומכרוב למפתן הבית,
מן מפתן הבית לכרובים, ומן הכרובים לשער הקדמוני,
משער הקדמוני לחצר, מן החצר לגג, מן הגג למזבח,
מן המזבח לחומה, מן החומה לעיר, מן העיר להר הזיתים.

נמצא שהמוטיב של שיבה למקום קודם מופיע כבר במסעות השכינה: לאחר שנטשה את הכרובים למפתן הבית, הרי היא שבה אליהם כבתחילה! אכן הדברים מוטעמים בהמשך המדרש שם:

ממפתן הבית לכרובים - 'ויצא כבוד ד' מעל מפתן הבית ויעמד על
הכרובים' (יחזקאל י, יח), ויצא - לא היה צריך קרייה למימר אלא ויבא,
ואת אמר ויצא, מהו ויצא? אמר ר' אחא: למלך שהיה יוצא מפלטין שלו
בכעס, משהיה יוצא היה חוזר ומגפף ומנשק בכותלי פלטין ובעמודי
פלטין, ובוכה ואומר: הוי שלום בית פלטין שלי, הוי שלום בית מלכותי,
הוי שלום בית יקרי, הוי שלום מן כדון הוי שלם, כך משהיתה שכינה
יוצאת מבית המקדש היתה חוזרת ומגפפת ומנשקת וכו'.

שיבתה שלשכינה למקום קודם לא מופיעה כאמור במימרת הבבלי, אך בעיקר המקבילות היא מצויה. והואיל ומסתבר אפוא שבמימרה המקורית היה מצוי מוטיב זה, הרי אפשר ואפשר שאף בגליות סנהדרין ביקש ר' יוחנן למצוא מקבילה לחזרת פרידה זו למקום קודם. וזו נמצאה לו בשיבה מאושה ליבנה. שהרי יבנה ביהודה היא, ושימשה תחליף של ממש לירושלים - שלא כבתי הדין שבגליל. אף מכאן מסתברת אפוא השיבה מאושה ליבנה כחלק מן המדרש המקורי.
ברם, הבבלי הרי לא קיים מוטיב זה של שיבת השכינה למקום קודם כחלק מן הפרידה; מסעות השכינה מתוארים אפוא בידיו כקו רצוף של התרחקות הולכת ונמשכת, מן הכפורת דרך התחנות שתוארו עד לשמי מרומים. מעתה יש בידינו להבין בדרך נוספת את המסורת שהשמיטה את השיבה ליבנה מכל וכל. הרי כבר נתבאר כי השמטת הבבלי את התחנה שבהר הבית הביאה לכך שאין במניינו אלא תשעה מסעות, וכבר ראינו כיצד השלימו את המניין על ידי יצירת השיבה לאושה. אך נראה שהייתה גם גישה נוספת אצל הלומדים. להבנתה יש להטעים כי מניין עשרה לא נזכר בפירוש באשר לגליות סנהדרין, ולא נאמר אלא במסעות השכינה; אלא שגליות הסנהדרין היו "כנגדן" של מסעות שכינה. אפשר אפוא שמתוך חסרון המניין היו מי שפירשו "כנגד" זה לא במובן כמותי דווקא; אלא כדרך ששכינה עזבה את מקומה שבמקדש בדרך הדרגתית, שלב אחר שלב, כך אירע אף בסנהדרין, אך לא במניין עיקרם שלדברים. מעתה, שלשון "כנגדן" נתפרש במובן איכותי, וסילוק השכינה בבבלי אינו אלא רצף של התרחקות גדלה והולכת, הרי ודאי שיבת הסנהדרין ליבנה מקלקלת את השורה: שיבה זו שוברת את קו ההתרחקות הנמשכת, למן לשכת הגזית ועד טבריה העמוקה מכולם, ואינה "כנגד" מסעות השכינה - לפי תיאורם בבבלי. כי בלא ידיעת המוטיב של חזרת-פרידה, השיבה ליבנה לא נראית כאחת מן הגליות, אלא אדרבה - כתחילת תיקונן. והואיל ובלאו הכי לא היה בידי הלומדים הללו מניין עשרה, הרי שיבה זו ליבנה נראתה תמוהה (כדרך שנראתה אף לחוקרים, מטעמיהם), ולבסוף הושמטה - ולא רק מפני טעות הדומות. שמונה מסעות הם אפוא (ולא תשעה) - אך במהותם הרי הם "כנגד" מסעות השכינה.
הלומדים שתפסו את ההקבלה למסעות השכינה במובנה הכמותי דווקא, הוסיפו אפוא שיבה לאושה; אבל הללו שפירשו הקבלה זו במובנה האיכותי הפחיתו את השיבה ליבנה. אלה ואלה יצאו מן המניין החסר שעלה בבבלי. השלמתו המקורית עולה מן הפיוט, שכלל במניין את המסע להר הבית. אך במפתיע נתכוונו לכך מדעתם חלק מלומדי הבבלי, והוסיפו את המסע לחיל. השיבה ליבנה, שהייתה חלק מן המימרה המקורית, מקבילה לשיבת השכינה לכרובים; אלא שזו נשתמרה דווקא בעדים הארץ ישראליים של המסורת.

בדברים דלעיל לא נדונה כל עיקר השאלה ההיסטורית הממשית, כלום שבה סנהדרין מאושה ליבנה. זאת לא רק מפני שאיני מתיימר לפותרה, אלא לפי שביקשתי להטעים את הצורך המתודי להפריד דרך שיטה בינה לשאלת המסורת הספרותית. בזו האחרונה אכן מאוששת דרך ממש שיבה זו (למעט השיבה השנייה מיבנה לאושה), וגלגולי המסורת מתבארים מתוך שיקולים פנימיים, הן בעלי אופי טכני (טעות הדומות) והן בעלי אופי ספרותי. מעתה עומד לרשות ההיסטוריון המצע הספרותי הטעון בחינה עובדתית.

Introduccion
La Base de Datos Interamericana de Derechos Humanos contiene documentos en inglés y español adoptados por la Comisión Interamericana de Derechos Humanos desde su primera sesión, celebrada en 1960. En virtud de la creciente necesidad de acceder a la jurisprudencia de este órgano, nuestros esfuerzos iniciales se han concentrado en poner a disposición del público los informes relativos a casos individuales. Asimismo, se han incorporado los informes de sesiones correspondientes a los primeros años de trabajo de la Comisión. La Base de Datos también incluirá los informes especiales sobre países y los informes temáticos adoptados por la Comisión desde sus inicios.
